1. Agreement to Terms
By accessing or using the Novapath website at novapath.appand any related applications or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
"Novapath," "we," "us," and "our" refer to Novapath and its operators. "You" and "your" refer to the individual accessing or using the Service.
2. Important Health Disclaimer
Novapath is a wellness and self-help tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment.
- The Service is not a substitute for professional medical advice, mental health treatment, psychotherapy, counseling, or any other form of healthcare.
- The AI companion is not a licensed therapist, psychologist, psychiatrist, or healthcare provider.
- If you are experiencing a medical or psychiatric emergency, call 911, go to your nearest emergency room, or call the 988 Suicide & Crisis Lifeline.
- Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical or mental health condition.
- Never disregard professional medical advice or delay in seeking it because of something you have read or experienced through the Service.
The information and support provided by the Service is based on published research and evidence-based approaches, but individual results may vary. Use of the Service does not create a provider-patient relationship.
3. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, please do not use the Service and consult a parent, guardian, or healthcare professional for support.
4. Account & Waitlist
- When you join the waitlist or create an account, you agree to provide accurate and complete information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights.
- Harass, abuse, threaten, or intimidate any person.
- Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the Service for any commercial purpose without our prior written consent.
- Transmit malware, viruses, or any other harmful code.
- Use automated means (bots, scrapers, etc.) to access the Service without our permission.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
6. AI-Generated Content
The Service uses artificial intelligence to provide personalized wellness support. You acknowledge and agree that:
- AI-generated responses are informational only and are not professional healthcare advice.
- AI responses may occasionally be inaccurate, incomplete, or not applicable to your specific situation.
- You should exercise your own judgment when acting on any information provided by the AI companion.
- We continuously work to improve the quality and accuracy of AI responses, but we cannot guarantee their correctness.
7. Intellectual Property
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, audio, software, and the overall design — are owned by Novapath or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Service without our prior written consent.
8. User Content
Any content you submit through the Service (including journal entries, messages to the AI companion, and survey responses) remains yours. By submitting content, you grant us a limited, non-exclusive license to use that content solely for the purpose of providing and improving the Service.
We may use aggregated, de-identified data derived from user content to improve our AI models and the overall Service. This data will never identify you personally.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to the practices described in the Privacy Policy.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free.
- The results obtained from the Service will be accurate or reliable.
- The Service will meet your specific needs or expectations.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NOVAPATH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You expressly acknowledge that the Service is not a substitute for professional healthcare, and Novapath shall not be liable for any health outcomes resulting from your use of the Service.
12. Indemnification
You agree to indemnify, defend, and hold harmless Novapath and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
13. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
